This Privacy Policy explains how Loadu Marketplace Limited ("Loadu", "we", "us", "our") collects, uses, shares, and protects information in connection with the Loadu platform at loadumarket.com and app.loadumarket.com. This Policy applies to verified business users (Buyers and Sellers) and their authorised representatives; Loadu is a business-to-business platform and does not knowingly collect data from individual consumers.
1. Data Controller
Loadu Marketplace Ltd is the data controller responsible for personal data processed through the Platform. Questions about this Policy or your data can be directed to legal@loadumarket.com.
2. Categories of Data Collected
● Identification data — name, role/title, and contact details of the individual representing a Buyer or Seller business; if you use Google Sign-In, the name, email, and profile information Google provides for authentication.
● Business data — business name, registration details (e.g. TRN, COJ or business name registration, RADA registration), sector permits and licences, address, and category (e.g. distributor, restaurant, hotel).
● Verification data — records of callback verification, video walkthrough recordings, site visit notes, and submitted documents.
● Transaction data — Listings posted, Orders placed, prices, quantities, payment confirmations, ratings, and communications related to an Order.
● Device and usage data — log data, IP address, device and browser type, and platform interaction data collected automatically.
● Communications — messages exchanged with Loadu support, and WhatsApp messages sent through the Platform's WhatsApp integration.
3. Sources of Data
● Directly from you, during account registration and verification, including via Google Sign-In if you choose that login method.
● From your use of the Platform, including Listings, Orders, and messages.
● From independent public sources used to confirm business identity during verification (e.g. Google Business Profile, Instagram business listing, Jamaica Tourist Board register, Ministry of Education or Ministry of Health registers).
● Automatically, through cookies, Google Analytics, Lovable's built-in analytics, and similar technologies described in Section 12.
4. Purposes of Processing
● To verify Buyer and Seller identity and eligibility before granting Platform access.
● To facilitate and process transactions, including payment collection and remittance.
● To operate platform features such as demand matching, listing categorisation, and quality grading.
● To analyse Platform usage and performance using tools such as Google Analytics and Lovable's built-in analytics.
● To communicate with users about Orders, account status, and Platform updates.
● To comply with legal, regulatory, and tax obligations.
● To send marketing communications, where you have given consent, which you may withdraw at any time.
5. Automated Processing
Loadu uses automated tools, including AI, to categorise listings, assess product quality from photos, and predict buyer demand. These tools assist and inform platform features but do not make final decisions about account approval, pricing, or order outcomes without human review. You may contact Loadu to ask about the logic behind an automated feature that affects you.
6. Legal Basis for Processing
Under the Jamaica Data Protection Act (2020), Loadu processes personal data on the following bases: performance of a contract with you (account services, transactions), compliance with a legal obligation (e.g. record-keeping, tax), Loadu's legitimate interests (e.g. fraud prevention, verification, platform security), and, where applicable, your consent (e.g. marketing communications). You may withdraw consent-based processing at any time without affecting processing already carried out.
7. Data Sharing
Loadu shares data only as necessary to operate the Platform:
● Payment processors (e.g. Lynk) — to process payments and remittances.
● Verification-related contacts — publicly listed business numbers and registers used to confirm identity, as described in Section 3.
● Google — for Google Sign-In authentication, and for Google Analytics usage data.
● WhatsApp (Meta) — where you use the Platform's WhatsApp integration to post listings or receive order alerts.
● Cloud infrastructure and service providers (e.g. Supabase, Lovable, Resend) — to host, run, and support the Platform, including Lovable's built-in analytics.
● Buyers and Sellers — limited transaction-relevant information (e.g. Seller identity and pickup details) is shared with the counterparty only after payment clears, consistent with the Platform's discretion mechanism.
● Legal and regulatory authorities — where required by law, court order, or to protect Loadu's legal rights.
Loadu does not sell personal data to third parties.
8. International Data Transfers
Some of Loadu's infrastructure providers (including Supabase and Lovable) host data outside Jamaica, including in the United States. Where data is transferred internationally, Loadu takes reasonable steps to ensure it continues to receive an appropriate standard of protection, consistent with the requirements of the Jamaica Data Protection Act (2020).
9. Data Retention
Loadu retains account, verification, and transaction data for as long as an account is active, and for a reasonable period afterward to meet legal, tax, dispute-resolution, and record-keeping obligations. Data no longer required for these purposes is securely deleted or anonymised.
10. Your Rights
Subject to the Jamaica Data Protection Act (2020), you have the right to:
● Access the personal data Loadu holds about you.
● Request correction of inaccurate or incomplete data.
● Request deletion of your data, subject to legal and contractual retention requirements.
● Object to certain processing, including direct marketing.
● Request portability of data you have provided, where technically feasible.
● Lodge a complaint with Jamaica's Office of the Information Commissioner (Masonic Building, 2nd Floor, 45–47 Barbados Avenue, Kingston 5; info@oic.gov.jm; (876) 929-8568) if you believe your data has been mishandled.

11. Security Measures
Loadu applies reasonable technical and organisational measures to protect personal data against unauthorised access, loss, or misuse, including access controls, encryption in transit, and restricted internal access to verification records. No system is completely secure, and Loadu cannot guarantee absolute security.
12. Cookies and Tracking
The Platform uses cookies and similar technologies to keep you signed in, remember preferences, and understand how the Platform is used, including through Google Analytics and Lovable's built-in analytics. You can control cookies through your browser settings; disabling some cookies may affect Platform functionality.
13. Social Media Links
The Platform and marketing site include links to Loadu's social media pages. Clicking these links takes you to a third-party platform outside Loadu's control; that platform's own privacy policy applies to any data collected there. Loadu does not receive personal data from these third-party platforms through the links alone.
14. Children's Data
Loadu is a business-to-business platform intended for use by authorised representatives of commercial entities. Loadu does not knowingly collect data from individuals under 18 and does not direct any part of the Platform at minors.
15. Third-Party Links
The Platform may contain links to third-party websites or services (e.g. payment providers), in addition to the social media links described in Section 13. Loadu is not responsible for the privacy practices of third parties, and this Policy does not apply to their sites or services.
16. Changes to This Policy
Loadu may update this Privacy Policy from time to time. Material changes will be notified through the Platform or by email in advance of taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Policy.
